Due Diligence





Aspen Environmental was contracted by a real estate law firm on behalf of a prospective buyer to conduct a Phase I environmental site assessment (ESA) on a property located within Palm Beach County. The property was being used as a fruit market/retail store and had a small outbuilding (a former residence) that was being used for storage. During performance of the Phase I, Aspen Environmental discovered that there had been historical land application of wastewater containing unknown sanitizers and detergents, and possibly a D001-ignitable hazardous waste on adjacent properties. Additionally, the wastewater that was discharged may have contained residual pesticides. Therefore, Aspen Environmental recommended a Phase II to determine whether contamination from this past practice had migrated onto the Target Property. The limited Phase II ESA was conducted in accordance with ASTM E1903-11. All field activities were performed in accordance with Florida Department of Environmental Protection (FDEP) Standard Operating Procedures (SOPs) for Field Activities (001/01). A direct-push drilling rig and/or hand auger was used to collect soil samples from the areas of concern. Soil samples were field screened in two-foot vertical intervals down to the water table using an organic vapor analyzer (OVA). Samples with the highest OVA readings were submitted to a certified laboratory for confirmation. Aspen Environmental also installed temporary monitoring wells on the properties to collect groundwater samples in order to determine whether any impacts to the groundwater had occurred. A detailed description of the procedures used to perform, and the findings of, the limited Phase II were compiled into a report in accordance with ASTM E1903-11 requirements. The results were presented in table, text, and map form. Additionally, Aspen Environmental hired a subcontractor to perform an asbestos survey on the buildings located within the property boundary. Aspen provided oversight on the asbestos survey.



Underground Tank Removal





Aspen Environmental was contacted to pursue closure of five 3,000-gallon underground storage tanks located at an automotive site in Vero Beach, Indian River County, Florida. The Aspen Environmental team visited the site to conduct pre-closure activities, such saw cutting the concrete to facilitate exposure of the tanks, pumping out the remaining liquid in the tanks, triple rinsing and degreasing them, and placing dry ice inside them. In addition, caution tape and barriers were placed around the site and a decontamination area was set up. The concrete pad was removed from the tank area and placed into a construction debris roll-off. Underpins were placed beneath the dispenser island closest to Tank #1 to stabilize the concrete footer in order to prevent collapse of the canopy while digging. Preliminary screening of the surface soil layer covering the tanks was also conducted. Subsequently, the five tanks were removed and placed on plastic sheeting material for cutting. The fuel lines from the dispensers were also drained and the liquid was placed in a 55-gallon drum. The entire tank area was backfilled and compacted with clean fill. All tanks and waste materials were handled and disposed of in accordance with appropriate state and Federal regulations. Prior to backfilling, closure sampling of the soil was conducted in accordance with the FDEP Storage Tank System Closure Assessment Requirements dated April 1998 and the FDEP Standard Operating Procedures (SOPs) for soil sample collection. Contaminated soils and groundwater were encountered at the site. Many of the OVA screened soils exceeded 4,000 ppm. The Aspen Environmental team recommended that a full site assessment be conducted at this property in accordance with 62-780 to delineate the contamination present.



Corporate Environmental Strategies and ISO 14001





Aspen Environmental was retained by a large manufacturer of natural gas turbines to conduct annual environmental regulatory compliance audits and ISO 14001 internal audits for multiple facilities within their organization over a period of many years. Aspen Environmental personnel were responsible for developing the environmental, health and safety corrective action reports and for monitoring their implementation. Additionally, Aspen Environmental was reponsible for the following:

1. Developing new environmental procedures (environmental work instructions) where necessary

2. Tracking progress towards environmental and safety objectives and presenting the results to management in a quarterly review meeting

3. Reviewing and updating Safety Data Sheet binders

4. Leading teams in developing environmental aspects and associated environmental impacts of their operations and subsequently creating a list of environmental objectives and targets to reduce or eliminate the facility's environmental impacts.

5.. Assisting the Houston-based facility in the transition during a merger/acquisition by a larger organization from an environmental standpoint

6. Reviewing and revising plans, such as the storm water management plan (SWPPP), the spill prevention control and countermeasures plan (SPCC), and the emergency action plan

7. Providing assistance during third party ISO 14001 certification audits

8. Assisting with environmental agency reporting requirements
